Our law firm processes personal data in accordance with the generally binding laws and regulations, in particular with Act No. 85/1996 Coll., Legal Profession Act, as amended, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the GDPR).

Legal basis for the processing of personal data and purpose for which personal data are processed:

  • In respect of personal data of our clients, we rely on performance of a contract, compliance with legal obligation and legitimate interests of the controller as legal reasons for the processing. We process such personal data for the purpose of exercise of legal profession, exercise of rights and fulfilment of obligations from a contractual relationship and protection of rights and legally protected interests.
  • In respect of personal data of our suppliers, we rely on performance of a contract and legitimate interests of the controller as legal reasons for the processing. We process such personal data for the purpose of exercise of rights and fulfilment of obligations from a contractual relationship and protection of rights and legally protected interests.
  • In respect of personal data of third parties who are in a relationship or in a dispute with our clients, we rely on performance of a contract and legitimate interests of the controller as legal reasons for the processing. We process such personal data for the purpose of exercise of legal profession and protection of rights and legally protected interests.
  • In respect of personal data of our employees, we rely on performance of a contract, compliance with legal obligation and legitimate interests of the controller as legal reasons for the processing. We process such personal data for the purpose of human resources management, exercise of rights and fulfilment of obligations from a contractual relationship and protection of rights and legally protected interests.

Personal data are disclosed in the exercise of legal profession or compliance with legal obligations towards public authorities, particularly courts and administrative authorities, and towards our partners in the field of legal services, accounting and IT support, all with full respect for the data subjects' rights and personal data security.

Personal data are processed for the duration of the legal reason for the processing; after its elapse, they are handled in accordance with generally binding laws and regulations, particularly with Act No. 85/1996 Coll., Legal Profession Act, as amended, and the GDPR.

As we are striving for a transparent approach to the processing of personal data, we would like to make data subjects familiar with their rights arising from the GDPR.

Your basic GDPR rights are as follows:

  • Right of access to personal data, i.e. the right to request us to confirm if we process your personal data. If so, you have particularly the right to ask for information about which categories of your personal data are being processed, for what purpose or to which third parties personal data will be disclosed and for how long your personal data are planned to be stored. Our duty to maintain confidentiality according to the laws concerning legal profession is not prejudiced.
  • Right to rectification of personal data, i.e. the right to request the correction or addition of your personal data if it is inaccurate or incomplete.
  • Right to erasure of personal data is, in other words, the obligation of the controller to destroy personal data which the controller processes about you, if certain conditions are met and you request it.
  • Right to restriction of processing of personal data, i.e. the right to request that we temporarily restrict the processing of your personal data in certain cases.
  • Right to object, i.e. the right to object at any time to the processing of your personal data, provided that your personal data is processed in our legitimate interests.
  • Right to data portability, i.e. the right to receive the personal data which you have provided to us in a structured, commonly used and machine-readable format. You can then transmit these data to another controller or (if technically feasible) ask one controller to transmit the data to another.
